There is another thing that has even more defense, the artistic license; I looked up poetic license and found this, in which it states that it allows the expression without the product being verbatum, such as examples with movies and television shows like CSI, Star Trek, and Disney's Pocahontas. It inorporates animated into the license. The game can carry on. Here are the links I looked at, for proof, and reference:

I just looked up the rules for the trademarks and such. It allows the first amendment to have presidense over the trademark law. The other things allowed, are commercializing for world knowledge, parody claiming, allowed under there being no confusion whereas the product is about the same original idea, and the fair use/good faith rule for not misdemeaning the original.
